Vietnam RCEP Trade Remedy Clause Implementation Guidelines to be Implemented from May 8

The Vietnam News Agency website reported on April 30, 2022 that the Ministry of Industry and Trade of Vietnam issued the “Guidelines for the Implementation of Vietnam’s RCEP Trade Remedy Clauses” (Notice No. 07/2022/TT-BCT) on March 23 this year, which will be released in 2022. Effective May 8th.

According to the notification, Vietnam’s investigation authority is obliged to notify the member state under investigation in writing at least 7 days before the Minister of Industry and Trade makes the decision to conduct an anti-dumping investigation and 20 days before the countervailing investigation, that the Vietnam investigation authority has received the anti-dumping investigation , the relevant materials of the countervailing investigation request. At the request of the government of the Member State concerned, the investigating authority is obliged to provide a non-confidential copy of the request document for a countervailing investigation.
